How Much Does Probate Cost? The are two financial components to probate: costs and fees. Costs are typically the charges for Court filing fees, Publication of the Notices, and the Probate Referee, among other things. Attorneys' and Administrator/Executor fees are separate. Those fees are set by California Probate Code section 10810 and based on the estate's value. For example: Estate Value Statutory Fee $100,000 $4,000 $200,000 $7,000 $300,000 $9,000 $400,000 $11,000 $500,000 $13,000 $600,000 $15,000 $700,000 $17,000 $800,000 $19,000 $900,000 $21,000 $1 million $23,000 An estate valued in excess of $1.0 million up to $9.0 million is 1%.
